qram.study Terms of Service

These Terms of Service ("Terms") govern your access to and use of qram.study, including the qram.study website, app, study tools, Sets, Global Sets, paid plans, and related services (collectively, the "Service").
By using qram.study, you agree to these Terms and to the qram.study Privacy Policy. If you do not agree, do not use the Service.
These Terms are written in plain language, but they still form a legal agreement between you and qram.study.
You must be at least 13 years old and old enough to lawfully consent to use online services where you live.
If the laws of your jurisdiction require you to be older than 13 to use qram.study without parent or guardian consent, then you may not use qram.study until you meet that higher age requirement or have any consent required by law.
qram.study is not intended for children who cannot lawfully consent to use the Service on their own. We do not knowingly allow such users to create accounts or use the Service.
By using qram.study, you represent that you meet the age requirement above and that your use of the Service is lawful where you live.
qram.study is a self-directed study tool for creating, importing, reviewing, practicing, publishing, cloning, and studying paired learning content.
The Service may include:
- Sets;
- term pairs;
- front terms;
- back terms;
- study challenges;
- Familiarity scores;
- study history;
- Global Sets;
- cloned Sets;
- public sharing tools;
- free and paid plans;
- qram.study-created study content;
- qram.study content created or improved with the help of AI or other automated tools.
The Service is a learning aid. It is not a school, tutor, instructor, testing authority, certification provider, licensing authority, legal advisor, medical advisor, financial advisor, or other professional advisor.
For these Terms:
- "Set" means a collection of term pairs created, imported, cloned, edited, published, or studied through qram.study.
- "term pair" means a paired learning item, usually made of a front term and a back term.
- "front term" means one side of a term pair.
- "back term" means the other side of a term pair.
- "User Content" means content that you create, import, upload, enter, publish, share, edit, or otherwise provide through the Service, including Sets, term pairs, Set names, descriptions, tags, accepted alternatives, usernames, profile information, support messages, and content-quality reports.
- "Global Set" means a Set that is public, discoverable, shareable, previewable, or cloneable through qram.study.
- "User-published Global Set" means a Set that a user creates or imports and then chooses to make public.
- "qram.study Global Set" means a Set created, curated, published, or made available by qram.study, including Sets created, reviewed, classified, corrected, or improved with the help of AI or other automated tools.
- "qram-ai" or "qram.study.AI" means a qram-controlled creator identity that may be used to create, manage, publish, or maintain qram.study Global Sets.
- "Clone" means an independent copy of a Global Set made by a user for private study or personal use.
You are responsible for your account and for all activity that occurs under it.
You agree to:
- provide accurate account information;
- keep your login credentials secure;
- not share your account with another person;
- notify us if you suspect unauthorized access;
- use the Service only for lawful study-related purposes.
We may set reasonable limits on accounts, Sets, term pairs, imports, exports, storage, public publishing, cloning, study features, rate limits, or other Service activity.
We may suspend or terminate accounts that violate these Terms or misuse the Service.
qram.study may offer free and paid plans, including Basic, Pro, or other plans we may introduce later.
Paid plans may include different limits, features, capacities, or access rights than free plans. Plan limits may apply to Sets, term pairs, imports, exports, sharing, Global Sets, study features, storage, or other parts of the Service.
### Subscription billing
Unless stated otherwise at checkout, paid plans are subscription plans that renew automatically until canceled.
Before completing a paid purchase, review the checkout page or billing flow carefully. The checkout page or billing flow will identify the plan, price, billing period, renewal terms, and any applicable taxes or charges.
By starting a paid plan, you authorize qram.study and its payment processor to charge the payment method you provide for the selected plan, including recurring renewal charges, applicable taxes, and any approved plan changes.
Prices are in U.S. dollars unless the checkout flow states otherwise.
### Payment processor
Payments and billing are handled by Stripe or another payment processor we may use.
qram.study does not store full payment card numbers. Payment card details are processed by the payment processor. We may store or receive limited billing information, such as your plan, billing status, payment processor customer ID, payment processor subscription ID, invoice information, receipt information, payment status, and limited payment method details such as card brand and last four digits if provided by the payment processor.
Your use of the payment processor may also be governed by that provider's own terms and privacy policy.
### Taxes
qram.study is a digital subscription service. In some locations, taxes, VAT, GST, or similar governmental charges may apply to your purchase.
Taxes may be included in the displayed price or shown separately during checkout, depending on how the checkout flow is configured and what applicable law requires.
To the extent qram.study is required to collect and remit taxes, those amounts will be handled through the checkout or billing process. You are responsible for any taxes or similar charges that apply to your purchase and are not collected by qram.study.
### Upgrades, downgrades, and plan changes
If you upgrade from one paid plan to another, the change may take effect immediately and may result in an immediate charge, prorated charge, credit, new billing period, or other billing adjustment shown during the upgrade flow.
If you downgrade or cancel a paid plan, the change usually takes effect at the end of the current paid billing period unless qram.study or the billing flow states otherwise.
If your subscription is canceled, downgraded, expires, cannot be renewed, or payment fails, qram.study may reduce your account to the applicable free or lower-paid plan and may limit access to paid features.
Changing plans does not necessarily delete your Sets or term pairs. However, some Sets, term pairs, exports, sharing tools, imports, study features, or other features may become locked, limited, hidden, or unavailable if they exceed the limits of your current plan.
### Cancellation
You may cancel a paid subscription through the account or billing management tools provided in the Service, or by contacting us at support@qram.study if you need help.
Cancellation stops future renewal charges, but it does not automatically refund charges already paid unless qram.study states otherwise or applicable law requires a refund.
You are responsible for canceling before the renewal date if you do not want the subscription to renew.
### Failed payments
If a payment fails, your payment method expires, a charge is reversed, or we cannot verify your subscription, qram.study may suspend, limit, downgrade, or terminate paid access until the issue is resolved.
### Refunds
Except where required by law, payments are non-refundable.
qram.study may consider refund requests case by case, but granting a refund in one situation does not require qram.study to grant refunds in other situations.
Deleting your account, not using the Service, forgetting to cancel, or exceeding plan limits does not automatically create a right to a refund.
### Price and plan changes
qram.study may change plan prices, features, limits, or billing terms from time to time.
If a change materially affects an active paid subscription, we will take reasonable steps to notify you as required by law or as appropriate for the change.
If applicable law requires your consent before a material subscription change applies, the change will apply only as allowed by law.
Your continued use of the paid plan after a change becomes effective means you accept the updated plan terms.
You are responsible for your User Content.
You represent that:
- you own your User Content or have the rights needed to use it in qram.study;
- your User Content does not violate anyone else's rights;
- your User Content does not violate these Terms;
- your User Content is lawful and appropriate for a study platform.
You keep ownership of your User Content.
By using qram.study, you give qram.study a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, process, display, transmit, format, index, analyze, and otherwise use your User Content as needed to operate, secure, support, maintain, improve, and provide the Service.
This license does not transfer ownership of your User Content to qram.study. qram.study's use of your User Content is also subject to the qram.study Privacy Policy.
For User-published Global Sets, you also give qram.study a license to display the Global Set publicly, include it in discovery surfaces, allow other users to preview it, and allow other users to clone it.
If you send us feedback, support messages, or reports about suspected errors or quality issues in qram.study content, you allow us to use those messages to investigate the issue, respond to you, improve the Service, and correct or improve content.
Sets are private by default unless you choose to publish or share them.
If you publish a Set as a Global Set:
- the Set may become publicly viewable;
- other users may preview it;
- other users may clone it;
- qram.study may show it in public or discovery areas;
- your username or public profile information may be shown with it;
- you are responsible for the content you publish.
A Clone is an independent copy. Once another user clones a Global Set, that cloned copy belongs to that user's account and may remain available to that user even if you later edit, unpublish, archive, or delete the original Global Set.
Unpublishing or deleting a Global Set may stop future public access or cloning, but it does not necessarily remove existing Clones from other users' accounts.
You should not publish private, sensitive, confidential, unlawful, or infringing content as a Global Set.
qram.study may provide Global Sets created, curated, published, or made available by qram.study. These may be published under qram-controlled creator identities such as qram-ai or qram.study.AI.
Some qram.study Global Sets may be created, reviewed, edited, classified, corrected, maintained, or improved with the help of AI, scripts, automated tools, manual review, or other content workflows.
These Sets are provided for study and informational purposes only.
We work to make qram.study Global Sets useful and accurate, but AI-assisted and human-reviewed study content can still contain mistakes. qram.study Global Sets may contain errors, omissions, outdated information, mistranslations, ambiguous terms, incomplete coverage, formatting issues, inappropriate equivalents, or other inaccuracies.
We do not guarantee that any Set is complete, accurate, current, suitable for a particular class, exam, assignment, certification, licensing process, profession, legal use, medical use, or other purpose.
You are responsible for verifying important information with authoritative sources before relying on it.
You may contact us at support@qram.study to report suspected errors, omissions, mistranslations, or quality issues in qram.study Global Sets. We may review reports and may correct, update, remove, or otherwise revise content at our discretion, but we do not guarantee that every report will be reviewed, accepted, or corrected.
References to AI-assisted qram.study content do not mean that qram.study provides in-app AI features to every user or that any plan includes AI features unless the Service or plan description specifically says so.
qram.study is a learning platform. It is not designed to store private, confidential, sensitive, regulated, or highly personal information.
You should not store, upload, publish, share, or include private or sensitive information in qram.study, including in Sets, term pairs, Global Sets, usernames, profile information, accepted alternatives, imports, or support messages.
Do not use qram.study to store or share:
- Social Security numbers or government identification numbers;
- financial account information;
- payment card information outside the official checkout or billing flow;
- passwords, secrets, keys, or credentials;
- medical or health information;
- legal case details or confidential legal information;
- private addresses or private contact information;
- private communications;
- information about another person without permission;
- confidential school, employer, client, business, legal, or medical information;
- any information that you are not allowed to use, publish, or share.
If you put private or sensitive information into the Service, you do so at your own risk and in violation of these Terms.
qram.study is a self-directed study tool designed to support learning, practice, and review. It is not a school, tutor, instructor, testing authority, certification provider, or guarantee of academic, professional, licensing, or examination results.
qram.study does not promise that using the Service will cause you to pass any test, exam, assignment, course, certification, licensing process, interview, or other evaluation.
Your learning depends on many factors outside our control, including your effort, honesty, study habits, prior knowledge, materials used, and the requirements of any teacher, school, employer, agency, court, licensing body, or testing organization.
Any scores, progress indicators, labels, study history, Familiarity scores, or similar features shown in the Service are learning aids only. They are not proof that you know a term, have mastered a subject, will remember material later, or are prepared for any real-world assessment.
Because qram.study is an unsupervised system, users may consult outside materials, guess, self-report inaccurately, mark items as familiar, or otherwise use the Service in ways that make their progress appear stronger than their actual knowledge.
You are solely responsible for how you study and for verifying your own readiness.
qram.study is not responsible for failed tests, incorrect assignments, poor grades, missed certifications, academic discipline, professional consequences, or any other outcome connected to your use of, reliance on, or misuse of the Service.
You may use qram.study only for lawful study-related purposes.
You agree not to:
- violate any law or regulation;
- upload, publish, or share content you do not have the right to use;
- infringe copyright, trademark, privacy, publicity, trade secret, contract, or other rights;
- publish private or sensitive information;
- publish confidential school, employer, client, legal, medical, or business information;
- harass, threaten, abuse, defame, or target another person;
- publish hateful, violent, sexually exploitative, obscene, or unlawful material;
- impersonate another person or misrepresent your identity;
- use qram.study to cheat, facilitate academic misconduct, or distribute restricted exam or assessment content;
- upload malware, malicious code, or harmful files;
- scrape, crawl, harvest, copy, or extract data from the Service except as allowed by normal product features;
- bypass or attempt to bypass security, access controls, rate limits, or technical restrictions;
- overload, disrupt, attack, reverse engineer, or interfere with the Service;
- sell, resell, sublicense, or commercially exploit the Service or qram.study-created content without written permission;
- use qram.study in a way that harms the Service, other users, or qram.study.
We may remove content, restrict public sharing, suspend accounts, terminate accounts, limit access, or take other action if we believe these Terms have been violated or if we believe action is needed to protect qram.study, users, or the public.
We may review account activity, usage patterns, Set metadata, public Global Sets, logs, device information, technical data, and other information associated with your use of the Service to detect, prevent, investigate, or respond to abuse, fraud, spam, security issues, scraping, excessive automated activity, violations of these Terms, or misuse of qram.study.
We may use automated tools, manual review, service providers, logs, monitoring systems, and security tools for these purposes.
We do not have an obligation to monitor all content or activity, and we do not guarantee that we will detect every violation.
The Service, including its software, design, interface, visual system, branding, logos, code, layout, features, qram.study-created content, and related materials, is owned by qram.study or its licensors.
These Terms do not give you ownership of the Service or qram.study intellectual property.
You may not copy, modify, distribute, sell, resell, scrape, reverse engineer, or commercially exploit the Service or qram.study intellectual property except as allowed by these Terms or by normal product features.
Your User Content remains subject to Section 6.
If you believe content on qram.study infringes your copyright, contact us at support@qram.study with enough information for us to review the claim.
Please include:
- your name and contact information;
- a description of the copyrighted work;
- a link or description of the allegedly infringing content;
- a statement that you believe in good faith that the use is not authorized;
- a statement that the information you provide is accurate;
- your physical or electronic signature.
We may remove or restrict content that we believe may infringe another person's rights. We may also ask for more information if a notice is incomplete or unclear.
qram.study may rely on third-party providers for hosting, database storage, authentication, sign-in, email, payments, billing, analytics, diagnostics, monitoring, security, customer support, and other functions.
For example, qram.study may use providers such as Vercel for hosting, Supabase for database and authentication, Stripe for payments and billing, and Resend for transactional email.
The Service may also link to third-party websites, dictionaries, references, content, tools, or resources.
We are not responsible for third-party services, websites, content, privacy practices, or policies. Your use of third-party services may be governed by their own terms and privacy policies.
We may modify, suspend, discontinue, limit, or remove any part of the Service at any time.
We do not guarantee that qram.study will always be available, uninterrupted, secure, error-free, current, or complete.
We may change or remove features, study modes, limits, Global Sets, public discovery tools, or other parts of the Service.
If a Service change materially affects an active paid subscription, Section 5 also applies.
The Service is provided "as is" and "as available."
To the fullest extent permitted by law, qram.study disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and reliability.
qram.study does not guarantee:
- that the Service will meet your needs;
- that the Service will be uninterrupted or error-free;
- that content will be accurate, complete, current, or suitable for your use;
- that study results, scores, Familiarity scores, or progress indicators reflect actual knowledge;
- that you will pass any test, course, assignment, certification, licensing process, or evaluation;
- that content created or improved with AI will be correct, complete, or free of omissions;
- that any content-quality report will be reviewed, accepted, corrected, or resolved.
Some jurisdictions do not allow certain warranty disclaimers. In those jurisdictions, the disclaimers apply to the fullest extent permitted by law.
To the fullest extent permitted by law, qram.study will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, service interruption, computer damage, academic consequences, professional consequences, billing interruption, payment failure, or other intangible losses.
To the fullest extent permitted by law, qram.study's total liability for any claim arising out of or relating to the Service or these Terms will not exceed 100 US dollars or the amount you paid to qram.study in the 12 months before the event giving rise to the claim, whichever is greater.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, the limitation applies to the fullest extent permitted by law.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless qram.study from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- your use or misuse of the Service;
- your User Content;
- your Global Sets;
- your violation of these Terms;
- your violation of law;
- your violation of another person's rights;
- your publication of private, sensitive, confidential, unlawful, or infringing content.
Before filing a claim against qram.study, you agree to contact us at support@qram.study and try to resolve the dispute informally. We will also try to resolve disputes informally before filing a claim against you.
Either you or qram.study may bring an individual claim in small claims court if the claim qualifies for small claims court.
To the fullest extent permitted by law, you and qram.study knowingly and voluntarily waive any right to a trial by jury for any dispute, claim, or controversy arising out of or relating to these Terms or the Service.
To the fullest extent permitted by law, you and qram.study agree that disputes will be resolved only on an individual basis. You may not bring a claim as a plaintiff or class member in a class action, collective action, representative action, private attorney general action, or similar proceeding, except where this waiver is not permitted by applicable law.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
Subject to small claims court and any rights you may have under applicable consumer protection laws, any dispute arising out of or relating to these Terms or the Service will be brought in the state or federal courts located in San Francisco County, California, unless applicable law requires another venue.
Nothing in this section limits any non-waivable rights you may have under applicable consumer protection law.
We may update these Terms from time to time.
If we make material changes, we will take reasonable steps to notify you, such as posting the updated Terms on the Service, updating the "Last updated" date, or sending notice through the Service.
If a change materially affects an active paid subscription, Section 5 also applies.
Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
